Fitbux, Inc. (“FitBUX”, “we” or “us”) provides consumer financial products and services (collectively, “Services”) via our Internet and mobile websites accessible at www.fitbux.com (our “Site”). We are part of the Rate affiliated companies which  includes Rate, Guaranteed Rate Affinity, Guaranteed Rate Insurance and Fitbux RIA, LLC. In providing the Services we collect, store and use information about consumers who visit or use our Site.

This Online and Mobile Application Privacy Notice (“Online Privacy Notice”) explains how we collect,why we collect, how we disclose, use, share and protect your personal information when you visit our websites, download our mobile applications (“apps”), use our websites and apps to engage with us, apply for a service or product electronically, access your account electronically, view, or interact with our social media pages, as well as interactions you may have while viewing content provided through a digital advertising or marketing campaign (collectively, “Online Services”). It also explains information about the choices that you can make regarding your information. By using our Online Services, you agree to the collection, use, and disclosure of information in accordance with this Online and Mobile Privacy Notice.

By using the App or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. 
  • Our Online site and Mobile Application services are not intended for children 18 years of age or younger. We feel strongly about protecting children’s privacy. We do not knowingly collect personally identifiable information from children. If you are 18 years old or younger, please do not provide us personally identifiable information of any kind. 
  • Third party links (including social media sites) appearing on our website or our mobile application have additional terms of use and privacy policies that may also apply to you. We are not responsible for third party sites or pages. Please review the privacy policies for the specific online sites you visit or use. We do not manage, and we are not responsible for the digital marketing and cookie practices of third parties. For example, third party website linked to or from our digital channels. The linked websites have separate and independent privacy statements, notices and terms of use, which you should read carefully. 
  • Your Personal Information Sharing Preferences are important. We would like to share your personal information with one or more of Our Affiliates in order to make you aware of different products and services they can provide which may be of interest to you. Our Affiliates include Rate, Guaranteed Rate Affinity, Rate Insurance, Ravenswood Title, LLC, Origin Point, LLC, Citywide Home Loans, LLC, Attorneys’ Title Guaranty Fund, Inc., Fitbux RIA, LLC, RateFit, LLC, Rate Travel, LLC, Rate Outdoors LLC, Tasso Design, LLC, Rate Supplements, LLC, Rate Homes, LLC whose websites and mobile apps may also link to this Privacy Notice. You can request that we not share your personal information with our Affiliates to market their products and services by contacting us at privacy@rate.com.

The Information We Collect & How We Use It
Information Collected from a PC, Tablet, or Mobile Device. We collect various types of personal information depending on how and to what extent you use our Online Services. When you browse our websites or use our mobile apps via a PC, tablet, mobile or other device, we may actively and passively collect: 

  • Device data. The types of data we may collect from your device include your device type, device identifiers, web browser type and version, operating systems type and versions, iOS or macOS, MAC ID, MAID ID, display/screen settings, language preferences, documents and photos stored in your device (e.g., to upload requested documents or identification cards we need to perform a service for you), internet protocol address (IP Address), mobile network information, mobile configuration data, general location (e.g., city, state, or country), geolocation/precise location (e.g., latitude/longitude), mobile advertising IDs (e.g. Apple’s IDFA or Google’s Ad ID), which version of our app is installed on your device, ISP or mobile carrier, mobile session ID and events (crash logs, up-time, run-time, and general performance and usage data) connections among different browsers and devices that you use (collectively “Device Data”). 
  • Important Note Regarding Location Data. When you access our online services or mobile app with your mobile device, location information may be available when your device communicates with a cell tower, Wi-Fi router or access point. Therefore, we may collect general location and geolocation information from the device you use when accessing our Online Services that tells us your approximate physical location. You control our ability to access your mobile location information. Refer to your device user guide and settings regarding how to allow, block, or limit collection of location information. If you choose not to provide location information, some Online Services may not operate correctly or be available to you. 
  • Online and mobile activity. We may collect your search history, information about how you use and interact with our Online Services or advertisements (such as, content viewed, links clicked, and features used), when and how often you use our Online Services, the webpage from which you clicked a link to visit our Online Services (e.g. referrer URL), browsing behavior within our websites and webpages, use of webtools (ex. Cookies and Pixel Tags), and feedback you may provide (collectively “Online Activity”).

Personally Identifiable Information

When you create an account or apply for our Services, we ask you to submit certain types of personally identifiable information. We use this information:

  • to ensure, as much as reasonably possible, that it is you, rather than someone else, applying for or using our Services in your name
  • to determine your eligibility for our Services under applicable law and our policy
  • to create and maintain your account
  • to communicate with you about your account or our Services
  • to securely process the payment transactions to which you and we might agree
  • to monitor and analyze our system performance and service offerings, to better serve you
  • to pull a credit report from a credit bureau, such as Experian, to help determine your creditworthiness

  • Eligibility information such as employment, income, or similar information (you may be eligible for our Services even if you are not employed)

  • Financial information such as your income, account balance, payment history, credit history, or credit scores.

FitBUX may also obtain more information about applicants from third parties to help us validate or supplement this information for the business purposes listed above.

In connection with certain analytic and advisory Services, we, our third-party service providers or partners may also collect from you or, as authorized by you, from certain third parties the following types of personal information or third-party data:

  • Your account balances, transactions and holdings from your financial institutions
  • Your financial goals
  • Your investment objectives
  • Employment and income information about your household
  • Retirement planning information about your household
  • Other information you elect to share with us about your spouse/partner and/or beneficiaries

Except as specified above, we do not permit any third party to collect personally identifiable information about an individual consumer’s online activities on our Site.

Non-Personally Identifiable Information

We may collect various types of information that are anonymous, de-identified or otherwise not intended to personally identify you (“Non-Personally Identifiable Information”) when you visit our Site or use our Services. Such Non-Personally Identifiable Information may include, as representative examples: network or Internet protocol address and type of browser you are using (e.g., Chrome, Safari, Firefox, Internet Explorer), the type of operating system you are using (e.g., Microsoft Windows or Mac OS), the domain name of your Internet service provider (e.g., Comcast, Verizon or AT&T), mobile network, device identifiers, advertising identifiers, the web pages of the Site you have visited, the type of handheld or mobile device used to view the Site (e.g., iPhone, Android), and tokens from online services and payment systems.

FitBUX also stores transaction history and user relationships/interactions.

We use such information as well as other anonymized user data in monitoring and analyzing our systems, performance and service offerings, to maintain and optimize our business and your user experience.

FitBUX may collect additional information in other ways not specifically described here. For example, we may collect information related to interactions with customer services, collections agents, surveys or other feedback tools from third parties using technologies such as application programming interfaces (APIs).

Information Sharing with Third Parties

For Everyday Business Purposes

In the ordinary course of business, we disclose applicants’ or customers’ information only for our everyday business purposes, such as to evaluate applications, process transactions, maintain account(s), or report to credit bureaus. For instance, in order to verify that the person applying for our Services in your name is actually you we obtain certain information, including corroborating information from certain third parties. To do so, we must first share some basic information in order to identify the person we are asking about. In all cases where we share your information for our everyday business purposes, we first require that our service providers agree by contract to take reasonable steps in conformance with industry standards to maintain the security and confidentiality of that information, and to use the information we share with them only for the purpose.

To Comply with the Law, or in Response to Court Orders and Legal Investigations

FitBUX may share your personal information to comply with the laws, regulations and rules by which we are governed.

FitBUX may be compelled to share personal information with law enforcement, government officials, or other third parties in the event of a subpoena, court order or similar legal procedure, or when FitBUX believes in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our User Agreement.

FitBUX may share personal information in the event of a merger or acquisition. Should such an event occur, FitBUX will seek to require that the new combined entity follow our privacy policy with respect to personal information you have provided.

We do not sell personal information, but we may share limited data with service providers and advertising partners consistent with applicable law.

FitBUX shares your personal information with third parties only as described in this policy. If we decide in the future to change this policy, we will post an amended version of this statement on our website and, where required by law, provide you the opportunity to opt out of certain sharing.

Information Sharing Non-Personal information 

We may also share non-personal Information, such as aggregate user statistics (e.g., number of downloads and registrations, and most popular merchants), demographic information and Usage Information, with affiliates and third parties, including advertisers, content providers, and analytics providers.

How We Use Cookies and Other Tracking Technologies

To enhance, secure and simplify your online experience, we use “cookies” or similar technologies. Cookies are text files placed in your computer’s browser to store your preferences. Cookies we use do not contain, capture or disseminate personally identifiable information.

We use temporary cookies to confirm that you are logged in. We use the information for security purposes, to facilitate your navigation of the Site (so you don’t have to re-log in as you move from one part of the Site to another), to display information more effectively, to personalize your experience and to recognize authorized devices to secure your use of our Services. We also gather statistical information about web site usage in order to continually improve the design and functionality and to assist us with resolving technical support questions. These cookies terminate once you close the browser. If you do not accept cookies from FitBUX, you will not be able to use our Site.

We also use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to FitBUX on future visits. We encode our cookies so that only we can interpret the information stored in them, but they do not contain personally identifiable information. You can remove or block the persistent cookie using the settings in your browser if you want to disable the feature.

Additionally, we or our service providers use cookies on our Site and the sites on which we advertise to track advertising performance and to collect aggregate data on web page viewing and mobile app usage. The privacy practices of the companies placing such cookies are governed by the privacy policies of such third-party companies or websites.

When you visit our Site or view one of our emails, we may use pixel tags (also called “clear” gifs), tracking links and/or similar technology to note some of the pages you visit on our Site and personalize your experience. We may also use pixel tags to determine what types of technology your browser supports. We may use the information collected through pixel tags, tracking links and similar technology in combination with your personally identifiable information.

How We Respond to Do Not Track Signals

Our website code is configured to automatically detect and honor Global Privacy Control (GPC) signals. If your browser transmits a GPC opt-out preference signal, our system will recognize it as a valid request to opt-out of the collection and sharing of your data via third-party advertising cookies. No further action is required from you to opt-out if this signal is active. Otherwise, you can change your privacy preferences regarding the use of cookies  and similar technologies through your browser. You may set your browser to accept all cookies, block certain cookies, require your consent before a cookie is placed in your browser or block all cookies. Our Commitment to Security

To protect user personal information from unauthorized access and use, we use security measures that comply with relevant laws and regulations. Beyond the policies described in this Privacy Statement, we have implemented the following measures to safeguard your information.

We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, to maintain data security, and to use correctly the information we collect online. These safeguards vary based on the sensitivity of the information that we collect and store. Only persons with a legitimate need based on their job function are authorized to access our customers’ personally identifiable information. We use technologies and practices that many banks and other financial institutions use to protect customer information, such as SSL encryption for data in transit and AES encryption for sensitive data at rest.

With regard to our analytic and advisory Services, after initial account aggregation, we do not store your financial institution credentials in our systems or in our applications. Our account aggregation service is provided by an industry-leading third-party account aggregation service. (See “Our Policy on Sharing Your Information with Third Parties” above.) That service employs comprehensive financial data security standards and is subject to ongoing multi-agency financial institution regulatory examinations.

Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this privacy statement.

How to Manage Your FitBUX Account Information

We understand that in the course of your relationship with us, certain of your personally identifiable information and preferences we maintain in connection with your account may change, such as your address, e-mail address, telephone number, and even your name. Accordingly, we allow you to update that information on your account. For active accounts in good standing, you may update most account information online once you log in at www.fitbux.com. If you are unable to make the updates on our Site, you may request the changes by contacting our customer service, but we might require supporting documentation in some instances, to protect you and us. We will continue to retain your prior personal information if required by law or as we deem necessary.

We Do Not Intentionally Collect Information on Minors or Non-US Residents

Only persons who are at least eighteen (18) years old, are resident in one of the United States or its territories or possessions, and have the right and capacity to enter into binding agreements under the law may open a FitBUX account or apply for our Services. If you do not meet those three conditions, you may not use our Site. We do not knowingly collect information from non-U.S. residents or from persons under eighteen (18) years of age.

Use of Artificial Intelligence

We are committed to responsible use of Artificial Intelligence (“AI”). We may use AI to process your personal information for purposes including but not limited to determining the product offerings marketed to you, providing communication through virtual chat bots, data analyses, synthesizing documentation and data, performing calculations and any such purposes to enhance your customer experience. We will not engage in such activities without your consent, or unless the processing is necessary for entering into a contract, product or service or for performance of a contract, product or service. Please note the use of automated decision making includes human oversight. When applicable, you also retain the right to request a human instead of automation such as with the use of a virtual chat bot. 

We may also use AI-powered tools and products to support us in day-to-day work (e.g. to create summaries, optimize workflows, draft correspondence, translate text or generate images). 

Retention and Deletion Practices 

We retain your information only as long as necessary to provide the products and services for which the information was collected, to process and maintain a record of transactions, and as long as necessary for legal process or to satisfy government retention requirements. To determine whether the data is needed, we consider the reason your data was collected and used and any legal requirements to hold onto your data. We review your data periodically to ensure it is still needed to fulfill the purpose for which it was collected or any other legal requirements. When the retention period expires, we destroy data that was maintained in any form in a manner that renders it completely unusable and incapable of restoration.
